Simmons Law Firm Presents Second 'Miles for Meso' Walk/Run Fundraiser for Mesothelioma Research

The Simmons firm sponsored the first annual Miles for Meso event September 26 in Alton, Ill. Nearly 500 runners and walkers registered, and through matching donations by the Simmons firm raised approximately $30,000.
"We're excited that so many people, with so many options to run or walk in events for other causes, supported Miles for Meso," said Chairman and CEO John Simmons. "We really were pleased by the support of our Metro East neighbors. Now, with the help of our friend Julie Gundlach, we hope to achieve the same results in St. Louis. Our simple goals are to make people aware of mesothelioma and generate funds for critical research."
Gundlach, who has been living with mesothelioma cancer since 2006 and participated in the Alton event, is helping lead the St. Louis event. Ghisallo Running is helping to coordinate the event.
Gundlach plans to run in the 5K for runners and walkers that will begin at Centennial Commons. "Unfortunately, mesothelioma is now everyone's problem," she said. "It's my hope that, through events like this, people come to start to understand that this is a preventable disease, and that we need the help of everyone to educate and raise money for research."
Mesothelioma is a rare and aggressive cancer caused by exposure to asbestos. The Simmons firm's sponsorship includes matching and donating 100 percent of all entry fees to the Mesothelioma Applied Research Foundation, a national nonprofit dedicated to funding critical research for better treatment options and, ultimately, to find a cure for mesothelioma.
The "Miles for Meso" event is open to participants of all ages. Prizes will be awarded to the top runners: the top three finishers in the men's and women's categories, including gift certificates to the Ghisallo's Running Store, credit towards a membership to Centennial Commons, and more. All participants will be eligible for five $100 drawings and other giveaways. The registration fee is $15 on or before October 1, $20 after October 1, and $25 for registration onsite the day of the race.
"The need for mesothelioma education, awareness, and research has never been more urgent," Simmons said. "Our firm is committed to funding research and building awareness about the disease so that we can assist in providing the needed critical help for families throughout Illinois, Missouri, and the entire country."

90 Fresno police employees exposed to asbestos!

Legal news for California asbestos attorneys. Construction work disturbed asbestos and may have contaminated 90 employees.
California asbestos lawyers alerts- Construction at the Fresno Police Department may have exposed 90 employees to asbestos.
Fresno, CA—Ninety Fresno Police Department employees found out on Monday, September 21, 2009, they may have been exposed to asbestos, a mineral fiber known to cause Mesothelioma cancer and asbestosis. Construction crews were installing fire-suppression equipment, when they discovered they disturbed materials possibly containing asbestos around 12:00 p.m. The construction work had reportedly been ongoing since September 14, 2008, as reported by the Fresno Bee.
According to city officials, a construction crew was installing fire-suppression equipment in two computer rooms near the police department’s communications center, when city employees noticed materials possibly containing asbestos were disturbed. As required by federal laws, asbestos must be removed or handled by a licensed asbestos abatement contractor. After the discovery the construction work was stopped, and the communications center was relocated off-site. Nearly 90 employees, mostly dispatchers and other police employees, had been working in the area where the asbestos was disturbed. Installers and employees entering the equipment rooms could have unknowingly carried the asbestos fibers on their clothes and into the communications center. Until the asbestos is abated, the communication center inside the building will remain closed, and employees will continue working at an off-site center. The affected employees have the option to seek their own medical attention and file a claim with the city.
According to Wikipedia http://www.wikipedia.org Asbestos is a known toxic material to humans. Primary and secondary exposure to asbestos and asbestos containing materials can cause respiratory illnesses and fatal diseases like mesothelioma lung cancer. There is no known level of safe exposure to asbestos. Abated asbestos materials are required by federal and state laws to be disposed of by licensed asbestos demolition and removal contractors at certified asbestos dumping areas.

Mesothelioma News: Students return to Vermont asbestos school

Shoreham Elementary School students began the school year two weeks late this year because of the presence of toxic asbestos. Addison County School officials allow Shoreham Elementary School students return after toxic asbestos materials were found in floor tiles. Shoreham, VT–Addison County Supervisory Union (ACSU) school officials permitted Shoreham Elementary School students to finally begin their 2009 school year this past week. The postponement of the September 2, 2009 school start date was a result of discovering asbestos and mold in early July. Shoreham Elementary School officials reported the hazardous asbestos materials were found during a routine carpet cleaning this past summer. Asbestos, a toxic material once commonly used in building materials like floor tiles, walls, ceilings, plumbing fixtures, and insulation, was discovered in floor tiles underneath the schools carpeting. As required by federal law any time asbestos materials are disturbed a demolition project to abate the asbestos materials is required. Direct and secondary exposure to asbestos materials can cause chronic respiratory illnesses and conditions like asbestosis and also lead to cancers like mesothelioma lung cancer. Rocks Containing Asbestos Linked to Mesothelioma

A new study suggests that rocks containing asbestos may cause mesothelioma.
Mesothelioma Cancer News (U.S.) – Researchers have found a possible link between exposure to natural sources of asbestos and the development of asbestos related diseases like mesothelioma. As reported by HealthandAge.com, researchers from the University of California, Davis, have found that living near rocks that contain the toxic mineral may be a risk factor for developing mesothelioma.
As noted in the report, the researchers examined 3,000 cases of patients with mesothelioma, and found that a large percentage were not verified to have been exposed to asbestos through occupational means, leaving open the possibility of their having been exposed by natural asbestos sources. California reportedly has the highest number of naturally occurring asbestos sources in the U.S.
More information on the subject may be found in the American Journal of Respiratory and Critical Care Medicine.

Two San Francisco Muni streetcars collide with SUV injuring 6!

Legal news for California train accident attorneys. Six people were left injured when two Muni street cars crash into a Nissan Pathfinder.
California accident attorneys alert- 2 San Francisco Municipal Railway streetcars hit a Nissan Pathfinder sport utility vehicle.
San Francisco, CA—A collision involving a sport utility vehicle (SUV) and two San Francisco Municipal Railway F-market streetcars left six people injured. The crash occurred on Monday, August 3, 2009 at 5:45 p.m. at Market and Noe streets, as reported by The Mercury News.
According to witnesses, the crash appeared to have happened when a Muni streetcar hit a Nissan Pathfinder and then pushed the SUV into another streetcar in front of it. The crash resulted in the SUV being sandwiched in between the two streetcars. According to a passenger on board the rear streetcar, which initially hit the SUV, it appeared the operator of the railway car was talking to a passenger right before the accident occurred. The driver of the Pathfinder and the streetcar operator were both transported by emergency medical service (EMS) crews to an area hospital for treatment of their injuries. Three injured people received treatment for their injuries at the scene of the wreck and were released. A fourth person reportedly declined treatment by EMS personnel. Reports indicated the injuries were not life threatening. San Francisco area police are reportedly conducting a full investigation.
This is the fourth accident this year surrounding the San Francisco Municipal Railways. In July, two light-rail trains slammed into each other at the boarding platform located at the West Portal Station, which left 44 people injured. In March, a Muni train collided with a tractor-trailer truck at the intersection of 22nd and Third streets in San Francisco. Multiple people reportedly suffered injuries in the collision. In addition, in February the N-Judah train stuck an Oakland Tribune reporter, William Brand, while he was walking near Second and King streets. The reporter tragically died from his injuries sustained in the accident.

California Mesothelioma Attorneys Carry The Load

It is not uncommon for people who have been diagnosed with Mesothelioma, a rare and deadly form of cancer brought on by exposure to asbestos, to require professional help. California mesothelioma attorneys have been receiving more and more clients due to the increase in mesothelioma diagnoses over the last several years. The country is reaching new heights in mesothelioma cases, at least this is what mesothelioma doctors are suspecting.

There is no question that California companies that expose their employees to dangerous levels of asbestos are negligible in the later onset of mesothelioma. Mesothelioma may not become apparent for as long as 40 years after the initial exposure. What is thrown into question is what is considered a dangerous level of asbestos. Most doctors will concur that dangerous levels of nearly any toxic substance are only based on averages. Some people will still develop mesothelioma after exposure to “safe” levels of toxic exposure based on their body’s sensitivity and their overall health.

When faced with mesothelioma, which carries an unfortunate life expectancy of 24 months or less, patients should really consider hiring one of the highly qualified California mesothelioma attorneys in order to deal with their affairs as well as file a mesothelioma lawsuit on their behalf. California mesothelioma attorneys have received extensive training in this field and are more qualified to deal with the complexities of mesothelioma cases than regular attorneys or attorneys who deal in other specialty areas of law. Mesothelioma cases are not simplistic by any stretch of the imagination.

Mesothelioma is like having the lining of your lungs burned over a period of ten, twenty, or thirty years. Corporate attorneys have been working on their defense for allowing this atrocity to occur, and thus the quality of the patient’s mesothelioma lawyer is especially important. Retaining a California mesothelioma lawyer is one of those decisions that requires research and understanding. The patient should be able to inquire as to the Mesothelioma lawyer’s track record, particularly when it comes to actual courtroom hearings and full scale trials. This is not an appropriate time for random selection or a basic internet search. If you or a family member has been diagnosed with mesothelioma in California, the lawyer which you hire will in fact be one of the most important decisions you will make while undergoing this terrible ordeal.

California mesothelioma attorneys are unfortunately gaining more experience by the day. With the onslaught of new cases, nearly 3,000 annually, Mesothelioma is no longer an obscure disease that only specialists and a few unlucky individuals have heard of. Mesothelioma and asbestos related diseases have claimed more than 45,000 lives in the past 20 or so years. It used to be that very few people understood the risks associated with asbestos exposure and what mesothelioma was. Unfortunately, the sobering reality has hit home for many.

Mesothelioma and asbestosis are diseases that could have been prevented, as the information on how to protect employees has been available to corporations since at least the 1930s if not earlier. This means that these companies knowingly placed the employees at risk without regard to their health. Many claim that this was done under the assumption that when mesothelioma was diagnosed years later, there would be no way to determine where the illness came from. Mesothelioma lays dormant for decades before striking the patient with symptoms.

California mesothelioma attorneys have had their hands full. With new claimants coming forward, often with enough claimants for a class action Mesothelioma lawsuit, there have been new discoveries made about the depth of this particular health crisis. Factory workers, miners, oil refinery workers, automotive workers, and construction workers are not the only ones coming forth with Mesothelioma lawsuits. Demolition crews, natural disaster survivors, roofers, those who work with pipelines and raw building materials, contractors, and though a tiny percentage, a few office workers have stepped forth. Typically, only office workers who worked in old renovated buildings have come down with Mesothelioma or asbestosis. The use of asbestos truly should simply be outlawed. If legislation like this should ever come forth, it will most likely come from the hearts and minds of California mesothelioma attorneys working diligently for you.

Two injured in Monterey County Petroleum tanker crash!

Legal news for California automobile accident attorneys. A Mitsubishi slams head-on into fuel tanker injuring a mother and son.
California automobile accident attorney’s alert- A collision between a fuel tanker and a Mitsubishi Galant leave victims with critical injuries.
Salinas, CA—A mother and son were left seriously injured after a head-on collision with a fuel tanker. The crash happened on Thursday, August 6, 2009 at 8:45 a.m. in Gonzales, as reported by the Monterey County Herald.
According to California Highway Patrol, a 2006 Mitsubishi Galant driven by Araceli Avila, along with her 5-year-old son, crossed the center divider and crashed head-on into a fuel truck. Avila was reportedly traveling northbound on Highway 101 when she struck the southbound truck. The force of the impact was so intense it ripped the engine from the car. Both Avila and her son were seriously injured and were transported by a medical helicopter to Santa Clara Valley Medical Center for treatment of their critical injuries. Avila sustained serious internal injuries, and her son suffered a broken femur bone in the crash. The boy reportedly was secured in a booster seat at the time of the crash. The driver of the fuel tanker, Rolano Yokaum, 59, of Salinas reportedly suffered wrist pains but refused to seek medical treatment.
According to witnesses, the car was allegedly driving erratically before the crash occurred. The head-on wreck left the Mitsubishi badly damaged, and was loaded on a flatbed truck and towed away. The fuel tanker, which is operated by Monterey County Petroleum, only sustained damage to the front end of the truck. Three fire engines from the Gonzales Fire Department, one fire truck from Salinas Rural Fire District, and crews from Caltrans all responded to the crash.

What is Mesothelioma?

Mesothelioma is a cancer that forms in the mesothelium, which is a protective membrane that covers the heart, lungs and other internal organs. This protective membrane is called by different names – for instance, the mesothelial lining around the heart is called the pericardium, around the lungs it’s called the pleura, and around the organs in the abdomen it’s called the peritoneum.

Mesothelioma can originate in any of these areas, and there are consequently three different types of mesothelioma:

Pleural mesothelioma
Peritoneal mesothelioma
Pericardial mesothelioma

The first two types – pleural and peritoneal – are the most common forms of this rare cancer, which occurs primarily in individuals who have experienced prolonged exposure to asbestos particles.

Who is at Risk?

Mesothelioma is typically diagnosed in people who have a history of workplace asbestos exposure.  Asbestos is a group of naturally-occurring minerals, composed of durable, fire-resistant fibers that have been widely used in industries such as:

Shipbuilding
Heating and construction
Textiles
Insulation
Automotive repair
Mining
Roofing and flooring
Education (asbestos was used in the ceiling tiles in older school buildings)

Individuals who have worked in these industries (especially prior to the 1970s when the government started regulating asbestos use) face the greatest risk of developing mesothelioma. Because of the widespread use of asbestos on Navy ships, veterans and others who worked aboard these vessels are also at an increased risk of being diagnosed with mesothelioma.

It is also possible to develop mesothelioma as a result of secondhand asbestos exposure. In other words, individuals who worked with asbestos could bring home the fibers on their person and thereby expose family members or loved ones.

Symptoms of Mesothelioma

Symptoms of mesothelioma may not appear until decades (30-50 years) after the asbestos exposure occurred, and even when they do appear they often resemble the symptoms of more common ailments. It’s always best to seek the advice of a doctor if any of the following mesothelioma symptoms occur in an individual with a history of asbestos exposure:

Shortness of breath
Chest pain
Weight loss
Abdominal pain and/or swelling
Fever

Mesothelioma can only be diagnosed by a doctor and diagnosis generally involves a battery of tests such as x-rays, CT scan and MRI, as well as a biopsy. Once mesothelioma is diagnosed, the doctor will determine the stage of the disease (how far the cancer has spread).

There is no cure for mesothelioma, but treatment may involve chemotherapy, radiation therapy, surgery, and any alternative therapies the patient and doctor deem appropriate.

Diagnosed with Mesothelioma?

Individuals who have been diagnosed with mesothelioma may be eligible to file a lawsuit to recover some or all of their damages. Damages often include treatment costs, pain and suffering, and loss of a loved one.

California Asbestos Removal Companies

Asbestos removal is the process of ridding a building or material of the asbestos that it may have been originally built with. Abatement companies all over California are busy with asbestos removal, in part due to the influx of asbestos litigation and mesothelioma lawsuits. Asbestos removal by a professional abatement company is only a fraction of the cost of a mesothelioma lawsuit.

Asbestos litigation can cost a company millions while asbestos removal only costs a few thousand dollars by comparison. Granted, large companies may have to spend more than a drop in the bucket to an abatement company for adequate asbestos removal, but it is still only a drop in the bucket when compared to the cost of a mesothelioma lawsuit, not to mention the human cost.

Companies of the seventies and earlier were permitted to build their buildings with large amounts of asbestos in order to protect them from the potential of fire damage. Companies and buildings created post 1980 were subject to different laws and were permitted what was then considered minimal amounts of asbestos in their production. Unfortunately, asbestos was still used in the automotive industry, construction companies, and a few other companies during this time.

Even older homes and office buildings were built using asbestos. Asbestos removal has become increasingly important as it is not so difficult to trace back one case of mesothelioma to a company, which means there is likely to be more asbestos litigation on the way. An abatement company can have the toxic material removed from the building in a very short period of time and workers can return to their employment with a renewed sense of safety.

Ironically, companies have become less devoted to their employee safety over the past 20 years. Abatement companies were much busier with jobs concerning asbestos removal with companies voicing concern for workforce safety ten years ago than they are today.

High turnover and the potential to leave a job and create a cheaper workforce are all reasons cited for this, but asbestos removal is appropriate regardless of the turnover rate or employee dissention. Asbestos litigation can occur regardless of whether the employee worked for the company all their life or only worked there just long enough to get sick.

Asbestos removal is a company’s best chance at avoiding costly asbestos litigation and defending themselves in a mesothelioma lawsuit. A mesothelioma lawsuit can cost a company upwards of ten million dollars by the time damages are awarded and court and attorney fees are factored in. Asbestos removal by a certified abatement company is really much cheaper.

While mesothelioma may take decades to surface after an employee has gone off to other employment or retired, many companies are finding that the damages awarded in a mesothelioma lawsuit are considerable less if they have gone through an abatement company and requested asbestos removal.

By following through with asbestos removal, juries do notice that there is obvious concern for employee health at a later time and do take that into consideration. Most companies who are involved in asbestos litigation are under new management or ownership by the time asbestos litigation is filed, and the public appreciates a minimal effort of asbestos removal.

Of course, this changes nothing for a mesothelioma victim, and asbestos litigation is still necessary in order to attain the financial means needed to fight for their lives. Doing something is still better than doing nothing.

Mesothelioma lawsuits and asbestos litigation are in effect helping to prevent asbestos related diseases as companies who follow through with asbestos removal are effectively removing the danger for future and present employees. This means that there is a chance that mesothelioma victims are helping to save lives by filing a mesothelioma lawsuit.

At least, it is considered hopeful that their fight will save a few lives down the road. Nobody can be certain of this, but asbestos removal, even if prompted by a legal case, is always the best preventative measure against mesothelioma.
